Accident Covered Despite Rule-Breaking

Even though an employee driving his employer's van was breaking company rules against transporting non-employees and drinking when he got in an accident, the company's liability policy covered the accident, the Missouri Court of Appeals' Southern District has ruled.

Trucking Co. Sued For Leaking Fuel On Highway

Truck Was 40 Miles Away At Time Of Crash $525,000 Settlement
The parents of Loni Prater brought a wrongful death lawsuit against Cynthia Sexton, James Patton and Potter Transport, Inc.
Prater, 18, died hours after an automobile accident on Nov. 23, 2000. She was slowing her vehicle on a hill in the rain on Highway 65 in Dallas County near Urbana when she was struck from behind by Sexton's vehicle. The collision forced Prater over the centerline, where she was hit by another vehicle.

Woman Suffered Brain Injury In Crash With Truck

She Claimed Driver Violated Federal Regulations $800,000 Settlement
Cheryl Dodson sued James Avis, a truck driver, and Avis Auto Transport, his employer, after an accident in Bolivar, Mo. Dodson suffered mild traumatic brain injury in the April 1, 2000 collision at the intersection of Highway 13 and Highway 32.

Girl Killed, Boy Injured In Crash With Truck

Truck Driver Said Pickup ‘Came Out Of Nowhere’ $750,000 Settlement
The mother of Bryan Harr and the parents of Colbey Oglesby sued Robert Brinegar, a truck driver, and Jarrod L. Calvin, his employer, after a September 2001 collision that injured Harr and killed Oglesby. The cases were consolidated for trial.
